The customer agrees that he will defend IQNetwork Active Media Limited opposite every court, ensure, keep far from any danger, from all the requirements, losses, financial claims and responsibilities and he will cover IQNetwork Active Media Limited from any cost included also the fee of lawyers, from any issue or claim because of damage or any other cause that any third person causes against IQNetwork Active Media Limited due to the activities and services or other actions of the customer or the content and information that was transfered through his hosting account.

For any mischief or damage caused through IQNetwork Active Media Limited' s services by the publication of any data, responsible for the retrieval is exclusively the user/customer.
Use Of Resources
As a limit to the use of the server's calculating power (CPU) and memory, it is set the 10% of the total server's resources. In case that the tasks that are executed at the customer's account are exceed in constant base the consumption of the 10% of the total server's resources, the customer is relatively informed so as to terminate the particular tasks. In case that the particular tasks cause or probably will cause any problem to the smooth server's operation and are adverse to the rest customers, IQNetwork Active Media Limited has the right to terminate the tasks without preceding any relative briefing to the customer.
The available server's resources are intended exclusively for use inside IQNetwork Active Media Limited' s customers' account. It is prohibited the disposal of resources in sites of third person by any way and by any form, and also included but not restricted the obtaining of graphics or texts from sites that are found in IQNetwork Active Media Limited' s servers, banner exchange programs etc. It is explicitly prohibited the use of irc bot chat script and chatrooms, because of the excessive workload that the above applications cause to the servers. The customer owes to checks the amount of his storage at IQNetwork Active Media Limited' s hard disks which he and the rest users of his account occupy, so not to exceed the limits that have been set. In case that the occupied storage has exceeded the limits, IQNetwork Active Media Limited has the right to delete files so the used storage to come back to the permissible limits. In case that the use of the resources, like this one of the highest monthly transfer of data, exceeds the limits that are included to the customer's account, IQNetwork Active Media Limited has the right to remove the cost of the moreover consumption from the rest plan, changing the expiration date or temporally interrupts its operation until the customer agrees with IQNetwork Active Media Limited for something more convenient for both sides.
Preinstalled Scripts
As the scripts are Open Source and their source code is widely known, it is possible for third parties to easily locate any security risks and exploit them in a malicious way. IQNetwork Active Media Limited does not have any responsibility if the customer's web site disfunctions because of the use of these scripts.
When a new update for a script is available, the customer receives informative email and in a reasonable time period he owes to update the scripts that he uses to the new version. If the customer overlooks the update of the scripts, especially when it comes for safety issues of the server, IQNetwork Active Media Limited has the right to force update the scripts that are used and does not have responsibility for any web page's disfunction after the update.
IQNetwork Active Media Limited has the right to stop providing some or all these scripts, in cases where a script makes a disfuction to the server's operation.
Sending of email or mass email, at recipients that have not asked the receipt of such messages (spamming).
Registration in mailing list of a recipient without his approval.
Advertising of services and products of sites that are hosted in IQNetwork Active Media Limited server through spamming at any indirect or direct way, even if the messages were not sent through IQNetwork Active Media Limited servers. IQNetwork Active Media Limited' s policy on spamming issues has null declension from the rules. By the first proven protest for spamming, the account, from which the message was sent, will immediately be suspended for any operation until the incident will be investigated and the customer is called to give explanations. In case that was not given satisfactory explanations within 24 hours, the account will be deleted without any other warning.
Activation - Renewall
The hosting account's renewal is made automatically before the expiration of the account and for the same time as that of the initial order on condition that the renewal fee will have to be paid until the expiration day. IQNetwork Active Media Limited owes to remind the customer by emails at least 10 calendar days before the expiration day of his account and also inform him about the alternative ways that he can pay for the renewal cost.
In case there is no payment for the renewal after the expiration day, then the day after the account expiration the customer's account will be suspended for 7 days, while at the same time it is also sent a new notice. If within these days the renewal cost will not be paid or there was no contact from the customer's side and any regulation for the issue, then the account is finally deleted. If the payment way is the credit card choise, the customer, according to the instructions that will be given to him, should proceed to a new charge of his credit card. IQNetwork Active Media Limited does not automatically renew the accounts by credit card with recharging the credit card. Any payment that is made for IQNetwork Active Media Limited by credit card concerns one and unique charge.
Interuption Of Contract
The present contract can be interrupted from anyone contracting, without cause. IQNetwork Active Media Limited is not compelled to return the agreed sum for the time that remains (from the interruption day until the regular expiration day of the account), in case the interruption is asked by the customer or the contract is interrupted by IQNetwork Active Media Limited in the event the customer had violated the terms of use. IQNetwork Active Media Limited has the right to deny, stop or suspend her services and will not be responsible for any consequences, positive or negative, that can result because of the deletion of the account.Guarantee
IQNetwork Active Media Limited' s hosting plans in virtual servers come with a guarantee of money return within 30 days, from the beginning day of the hosting account. If the customer is not satisfied from IQNetwork Active Media Limited' s services' level, within 30 days from the beginning of his account, he can ask the cancellation of the present contract. In this case the total sum of the hosting plan returns to the customer. In case that the sum of the account included more expenses (domain name registration, supplies of third persons or supplies of banks or credit cards, expenses of installation, additional services) then the sum returns to the customer after the above expenses are retained. No money return can be made after the 30th day of the subscription. The above guarantee concerns exclusively the plans of renting virtual servers and not all the provided services from IQNetwork Active Media Limited. The 30 day money back guarantee does NOT apply to Domain Name Registration or Web Site Design Services.
Special Terms
The customer responsibly declares that according to the corresponding law of the Republic of Cyprus.
The data that stated to the present application is real and precise.
He does not violate under his knowledge rights of third persons.
He commits the specific legal person (in case of legal persons).
In case that the application concerns service that will be used by third person or becomes on behalf of a third person he has the complete authorization from this person to use his data and his actions are aware by this third person.
Customer's Obligations
The customer is obligated to inform IQNetwork Active Media Limited for any change of his contact data.
The customer is obligated to pay the fees that are indicated to IQNetwork Active Media Limited' s web site. In case that his sum is not paid within the allowed dates to IQNetwork Active Media Limited, then the application's submission is concerned not submitted.
The customer must use the offered services according to the present telecommunication laws and any illegal use of his part can cause criminal or civil penalties.
Service Charge
The customer is charged for the services which are offered to him according to the IQNetwork Active Media Limited' s pricelist, which IQNetwork Active Media Limited modifies it according to the present legislation . The prices are incurred by 15%, and 0% of VAT according to the case.
The pricelist is published in the IQNetwork Active Media Limited 's website and the prices include the fees that are given from IQNetwork Active Media Limited to Eurid.
The customer must settle his obligations towards IQNetwork Active Media Limited during the application's submission and always according to the ways of payment that are agreed with IQNetwork Active Media Limited.
IQNetwork Active Media Limited edits and sends the corresponding receipts at the given address of the customer.
Renewall
The right which is acquired from the registration of a .eu domain name, lasts for one year after the submission of the registration application.
The registration can be continuously renewed for one year period, after the payment of the corresponding fees.
When the registration or renewal period expires, the .eu domain names are deactivated from the registry after a previous decision of the Eurid.
Being In Effect Right
The present Convention will be conditioned by the European Right and the Right of Republic of Cyprus, and will depend in the exclusive jurisdiction of courts of Nicosia.
